There is a common misconception among members of the profession (or registrants as they are referred to in the college bylaws) that conflates the College with educational institutions or a professional association. The Ontario College of Pharmacists (OCP) is distinct from these entities; it operates independently from academic bodies and professional associations.To accurately describe the College, one must understand its fundamental legal nature as a "Creature of Statute." Self-regulation is a privilege granted to our profession — one that carries significant responsibilities and advantages when done appropriately and is strengthened when more pharmacists and pharmacy technicians choose to become actively involved in the College.A creature of statuteIn legal terms, defining the College as a "Creature of Statute" means that its existence, authority, and powers are derived exclusively from legislation.Distinct from a private corporation or a voluntary association which may define its own role, the College acts solely as an agent of the law. It possesses only the powers explicitly granted by the legislature. It is bound by its enabling statute; it must act strictly within its legislative mandate and maintain its defined jurisdiction.In short, the law is not just a guideline for the College—it is the source of its very existence and the strict boundary of its authority.The legislative framework: The Regulated Health Professions Act (RHPA)The primary legislation governing the College is the Regulated Health Professions Act (RHPA). This "umbrella" legislation standardizes the regulatory framework for all 26 health colleges in Ontario, including nursing, medicine, and dentistry.The RHPA establishes the jurisdictional boundaries for the profession. It defines the regulatory framework or in common terms “the scope of practice” for the regulator itself. Just as a clinician must practice within their authorized scope, the College must operate strictly within the legal parameters set by the Act. Any action taken outside these parameters maybe considered ultra vires (beyond its legal power) if challenged in court or by judicial review.A social contractThe RHPA establishes a "social contract" between the pharmacy profession and the Government of Ontario.The Grant of Authority: The government grants the profession the privilege of self-regulation, allowing pharmacists and pharmacy technicians to set standards for their own peers.The Fiduciary Duty and Loyalty to the Public: In exchange, the profession accepts a solemn fiduciary duty to the public. This demands unwavering loyalty to the public interest, requiring that patient interests always come first and that the public interest takes absolute priority over any self-interest of the profession . The RHPA states that the object of each regulated College is to serve and protect the Public Interest when carrying out their objects as stated in the Act (see the reference below).Defining “The Public” and the scope of public interestInterestingly, the legislation does not provide a specific definition for “the public.” It is crucial to understand that “the public” is not synonymous with “patients.” The absence of a rigid legal definition gives the OCP and other health colleges significant flexibility to interpret what constitutes the public. This enables the regulator to address broader societal needs and public safety concerns that extend well beyond the immediate interests of individual patients currently receiving care.Furthermore, “public interest” is a broad concept that may also encompass the well-being of the profession itself. A sustainable, competent, and healthy pharmacy workforce and economic model is inherently in the public interest because it ensures patients have reliable access to safe care. Supporting the profession’s capacity to deliver safe and effective care is therefore often a necessary step in protecting the public.This broader understanding of the public interest is reinforced by the Ontario College of Pharmacists’ Code of Ethics, which states that the Code guides pharmacy professionals in fulfilling the College’s mandate to serve and protect the public interest by putting patients first.This perspective necessitates a critical distinction between the mandate to protect the public interest and the mandate to serve the public interest when it serves its objects:Protecting the Public Interest: Focuses on risk mitigation—preventing harm, enforcing standards, and disciplining incompetence or misconduct.Serving the Public Interest: Focuses on beneficence—actively enhancing the quality of care, promoting accessibility, and optimizing health outcomes for the public, which includes both patients and the broader community.Governance structureThe governance structure of the College reflects the accountabilities discussed above. The Council (Board of Directors) is composed of a strategic mix of members that balances public oversight with professional expertise:Public Members: Appointed directly by the Lieutenant Governor in Council, these individuals are outside the profession. Their presence ensures that the public perspective remains central to all decision-making.Professional Members: Pharmacists and Pharmacy Technicians elected by their peers. Their presence ensures that expert knowledge (eg. clinical or operational) and the realities of practice inform regulatory policy.Pharmacy School Deans: Deans serve on the Councils of specific Regulated Health Professions Act (RHPA) Colleges, such as those for pharmacy, dentistry, and medicine, only when explicitly mandated or permitted by the legislation or by-laws. They are not required to be on every RHPA College Council. The Pharmacy Act requires that the Dean of each faculty of pharmacy of the universities in Ontario sit on Council.The role of professional membersWhile professional members are elected, their role differs significantly from that of an advocacy body representative. A Board member uses their professional expertise to govern in the public interest. They ensure that regulatory decisions are practical to sustain a competent profession—outcomes that are essential for the public's benefit—rather than advocating for the profession's self-interest.Accountability and responsibilitiesThe College operates under a robust framework of accountability, answering to the public, government and its own members (or registrants as they are referred to in the bylaws).1. Accountability to the Public The College is directly accountable to the citizens of Ontario through transparency mechanisms. This includes the requirement to hold Board meetings that are open to the public, publish discipline decisions, and maintain a public register (Find a Pharmacy or Pharmacy Professional). Additionally, the legislation grants the Board the broad authority to pursue "any other objects relating to human health care that the Board considers desirable," ensuring the College remains accountable for responding to the evolving needs of the public beyond its explicit regulatory functions.2. Accountability to the Government (The Minister of Health) While the College operates independently, it is subject to statutory oversight by the Minister of Health, and as such acts as an arm of the provincial government and must submit annual reports to the Minister of Health. The Minister retains broad powers to oversee operations, including the legal authority to require the College to make regulations, audit its operations, or even appoint a supervisor to take over its administration if it fails to fulfill its mandate (and there has been recent precedents of this occurring with other health regulatory colleges).3. Accountability to the Profession (The Members/Registrants) The College is accountable to the professionals it regulates. This accountability is structural, financial, and democratic:Democratic Elections: Professional members of the Board are elected by their peers. This grants members the authority to determine who governs the profession. If members are dissatisfied with the direction of the College, they have the power to elect new leadership.Fiscal Stewardship: As the College is funded mainly by registrant and pharmacy fees (not tax dollars), it acts as a steward of the profession's resources. It is accountable to the registrants for using those funds efficiently to fulfill its statutory mandate.Procedural Fairness: In all registration, complaint, and discipline processes, the College is legally accountable to act impartially and respect the rights of the member/registerant.Constructive Relations: The Regulated Health Professions Act explicitly includes an object to "promote and enhance relations between the College and its members (registrants)," creating a statutory obligation for the College to engage constructively with the profession.The distinct nature of pharmacy: The Pharmacy ActWhile the RHPA provides the general framework for all health professions, the Pharmacy Act provides the specific context for pharmacy.Most health regulatory bodies focus exclusively on the Person (the practitioner). However, the OCP is unique among health colleges because the Pharmacy Act and related legislation grant it a broader scope. The OCP regulates a tripartite system: the Person, the Place, and the Product.Regulating the Place: Unlike the College of Physicians and Surgeons, which regulates only practitioners, the OCP has the statutory authority to accredit, inspect, and monitor pharmacies. This ensures that the physical practice environment meets rigorous safety and operational standards.Regulating the Product: Through the Pharmacy Act and the Drug and Pharmacies Regulation Act, the College enforces standards regarding the control, storage, and distribution of pharmaceuticals, ensuring the integrity of the drug supply chain.ConclusionThe Ontario College of Pharmacists is more than a regulator; it is the statutory body responsible for regulating the profession in the public interest.
